By order of the Commercial Court of Vienna dated 28 December 2023, restructuring proceedings with self-administration were opened regarding the assets of SIGNA Prime Selection AG and ABEL Rechtsanwälte GmbH was appointed as restructuring administrator (case no. 6 S 206/23w). The restructuring plan of SIGNA Prime Selection AG (trustee restructuring plan according to §§ 157 ff IO) of SPS was accepted on 18.03.2024. The restructuring plan provided for a complete realization and distribution of the entire debtor’s assets to the creditors, with the assets being handed over for realization and monitoring by the then restructuring manager as trustee.
The reorganization plan was subsequently refused court confirmation. As a result of the decision of the Austrian Supreme Court of Justice, the Commercial Court of Vienna, in its decision of October 31, 2024 (ON 270) regarding case number 6 S 206/23w, changed the designation of the insolvency proceedings from reorganization proceedings to bankruptcy proceedings in accordance with § 176 (3) IO. Self-administration was withdrawn in accordance with § 170 IO and Abel Rechtsanwälte GmbH was appointed as insolvency administrator.
